Terms of Service

Our goal is to provide you with an exceptional service that we have worked tirelessly to create. By using our services, app, and website, you agree to abide by our terms and show respect to Pebbls. We don’t have any hidden or deceitful clauses in our terms, but if there is something that you don’t agree with, we kindly ask that you do not continue to use our platform. We wish you the best of luck in finding another amazing travel blogging platform if that is the case.

We are not going to be harvesting your data or passing on your contact details – we promise. The data that you provide will be used for the sole purpose of offering you the best possible experience while using Pebbls.

In the text below we’ll be using some wording such as “you” and “your” – this means we are talking about you, the person who will be using Pebbls. When we refer to “we”, “our” and “us”, this is referring to the creators of the Pebbls platform. We also use the terms “post”, “posts”, and “content” – this refers to anything that you, or another user, may add to Pebbls including location data, photos, videos, and text.

We are based on the beautiful little island of Guernsey and as such any disputes of these terms and conditions will be contested under Guernsey law. Our data is stored within secure data centres in the USA.

Cookies

When using our website (including viewing journey maps) we make use of cookies. The cookies that we use are there to store your user access token and personal preferences (such as whether you prefer to use kilometers or miles). We also use third-party cookies from CloudFlare, Google Analytics, and New Relic to analyze information about how and when different parts of our site are accessed. This isn’t unusual, almost every website that you visit makes use of cookies. If you disable cookies in your browser then you will not be able to experience all of the wonderful features that we have created for you. Trust us, when used correctly (like we use them), cookies are there to make your experience better.

Location Data

The whole purpose of Pebbls is to track and share your journeys, which means we need to know where you are and where you’ve been. By using our app, you’re telling us it’s ok to collect and use your location data to create your Pebbls map.

If you are on a trip with your friends or family members, make sure they’re okay with you collecting and sharing their location data too. We don’t want anyone’s privacy invaded, so please be respectful and get their permission first.

We only collect your location data when you have journey tracking enabled or when you manually place a Pebbl map marker.

If you decide to turn off location services for Pebbls in your device settings, the app won’t work as intended. So, to get the full Pebbls experience, keep your device location services turned on.

User Conduct

Pebbls is a community platform designed to enable users to share their experiences and adventures with others. As such, we expect our users to act responsibly and respectfully towards other members of the community. By using our services, you agree to abide by the following conduct guidelines:

• Respect others: We expect all users to be respectful towards other members of the community. This means refraining from posting or engaging in any behavior that is discriminatory, harassing, threatening, or otherwise offensive towards others.
• Be truthful and accurate: We encourage users to share their experiences honestly and openly. However, we ask that you do not post or share content that is knowingly false or misleading.
• Protect privacy: We take user privacy seriously and expect all users to do the same. This means not sharing personal information about yourself or others without their explicit consent.
• Follow the law: We expect all users to follow applicable laws and regulations while using our services. This includes refraining from posting or engaging in any behavior that is illegal or promotes illegal activity.
• Report inappropriate content: If you come across any content that violates our terms of service, please report it to us immediately. This includes any content that is offensive, abusive, or violates someone else’s privacy.

We reserve the right to remove any content or user accounts that violate our terms of service or that we deem inappropriate. We also reserve the right to modify or update these guidelines at any time.

Intellectual Property Rights

We take intellectual property rights seriously and expect all users to do the same. The Pebbls platform and all content and materials on it, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, software, and any other intellectual property or proprietary information, are the property of Pebbls or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

By uploading or submitting any content directly to Pebbls (e.g., Pebbls notes, photos, and videos), you grant Pebbls a non-exclusive, royalty-free license to use, store, display, reproduce, modify, and distribute your content on the Pebbls platform and through any other channels or media, including social media and other websites, for the purpose of promoting and marketing the Pebbls platform.

This usage is limited to 3 posts, where 1 post may be shared across multiple platforms (e.g., social media, website, newsletters). If Pebbls wishes to use the content beyond these 3 usages, a fee will be offered, and the specific terms will be agreed upon before any extended use.

Please note that this does not apply to external content such as YouTube videos, blog posts, or social media posts linked to your Pebbls map. External content will remain solely within the control of the user, and Pebbls will not assume any rights to use it for promotional purposes without seeking prior permission.

Any content uploaded by you must be your own work and must not breach any copyright or intellectual property rights. This includes any soundtracks or audio that you may use within your videos. You can find royalty-free soundtracks using various online resources.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Pebbls platform or its content without our express written consent. You also agree not to use any automated devices, such as robots or spiders, to access or use the Pebbls platform or to monitor or copy any content or information on the platform.

If you believe that any content on Pebbls infringes your intellectual property rights, please contact us immediately at [email protected] with the following information:

• A description of the copyrighted work or other intellectual property that you claim has been infringed;
• A description of where the material that you claim is infringing is located on the Pebbls platform, including the URL, if applicable;
• Your address, telephone number, and email address;
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

We will investigate any claims of intellectual property infringement and take appropriate action, including removing or disabling access to any content that is claimed to be infringing, terminating accounts of repeat infringers, and/or terminating access to the Pebbls platform.

Personal & Public Safety

While we encourage exploration and adventure, we also want to remind our users to prioritize personal and public safety at all times.

When using Pebbls, it’s important to remember that you are responsible for your own safety and the safety of others. This includes following all local laws and regulations, being aware of your surroundings, and taking necessary precautions to avoid potential risks and hazards.

Additionally, please be respectful of public and private property, and consider the impact of your actions on the environment and local communities.

We want you to have a safe and enjoyable experience while using Pebbls, and we ask that you use the app responsibly and with consideration for yourself and others.

License

Pebbls is a project of passion. We have spent considerable time carefully sculpting and re-sulpting every beautiful line of code of Pebbls. This means that we, and those third parties whose code we have incorporated into Pebbls own the intellectual property of all materials on Pebbls. Any content uploaded to Pebbls, such as text, photos and videos, remain the ownership of its original creator. Any content uploaded by you must be your own work and not be in breach of any copyright infringement – this includes any soundtracks or audio that you may use within your videos – you can find plenty of royalty free soundtrack resources by using your favourite search engine.

Please do not:

• Republish material from Pebbls.
• Sell, rent or sub-license material from Pebbls.
• Reproduce, duplicate or copy material from Pebbls.
• Redistribute content from Pebbls.

This agreement is valid from 1 March 2023.

We do not moderate or filter content before it is posted to Pebbls and so it might happen that a user posts content which is inappropriate or against Pebbls’ guidelines. These posts are not representative of our views or opinions and we have no control over what users choose to post. We do however have the facility for users to report for review any content that they feel is inappropriate, against our guidelines, or in breach of law. We will remove any content that we deem inappropriate and the offending user may be permanently banned from Pebbls and reported to the appropriate authorities. To the extent permitted by applicable laws, Pebbls shall not be liable for the posts or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the content on Pebbls.

We wish to keep Pebbls a safe and friendly place and so we reserve the right to monitor all content and to remove anything which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

Explorer Membership

We offer an optional paid membership plan called “Explorer Membership” which provides additional features and benefits beyond the free version of our platform. By subscribing to Explorer Membership, you agree to pay the annual subscription fee of $19.99 USD (varies by location & exchange rate) via Apple or Google’s in-app subscription services. Your subscription will automatically renew each year unless cancelled by you. You can manage or cancel your subscription at any time through your app store account settings.

As an Explorer Member, you will have access to additional features and benefits, which may include but are not limited to:

• Ability to create private journeys that are only visible to selected users
• Ability to password protect your journeys
• Ability to use live location tracking

We reserve the right to modify or update the features and benefits of Explorer Membership at any time, and we may also introduce new membership plans in the future. Any changes or updates to membership plans will be communicated to you through the platform or by email.

Please note that your Explorer Membership subscription is subject to the terms and conditions set forth by Apple or Google, as well as our own Terms of Service. If there is a conflict between our terms and those of the app store provider, their terms will take precedence.

By subscribing to Explorer Membership, you agree to abide by all terms and conditions outlined in this section, as well as the rest of our Terms of Service. We reserve the right to modify or update these terms at any time.

Service Disclaimer

We have created Pebbls to enable you to share your adventures and experiences with others via our website, however we make no guarantees or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability of our service, website, or app. This means that if for some reason you are caused upset, or suffer any damage, injury, or loss whatsoever as a result of using our service, or of our service being unavailable to you, then in any circumstance we will not take liability. Any reliance that you place on our service, website, or app is therefore strictly at your own risk. The inclusion of any links on our website does not imply any kind of endorsement

We will not be liable for any loss or damage of any nature.

User-Generated Content Disclaimer

The content posted on Pebbls is the responsibility of the individual users and does not necessarily represent the views or opinions of Pebbls. Pebbls does not endorse, guarantee, or make any representations or warranties regarding the accuracy, completeness, timeliness, reliability, or usefulness of any information or opinions posted on the platform. Users are solely responsible for the content they post on the platform and Pebbls assumes no liability for any content posted by users, including any tips or advice related to safety. Users should always exercise caution and do their own research before acting on any advice or tips found on Pebbls, and should consult with appropriate professionals for specific advice related to their travel plans.

The Pebbls platform has been built as a free application. This service is provided by Pebbls and is intended for use as is. We do offer a paid premium membership with a few additional features (such as password protected journeys).

This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information for anyone who decides to use our Service.

By using our Service, you agree to the collection and use of information in relation to this policy. The Personal Information we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.

The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible at Pebbls unless otherwise defined in this Privacy Policy.

Information Collection and Use

To enhance your experience while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to name, email address. The information we request will be retained by us and used as described in this privacy policy.

Our app uses third-party services that may collect information used to identify you.

Location Data

The Pebbls mobile app collects and uses your precise location data to provide and enhance the functionality of our journey tracking features and to create personalized maps. This location data is linked to your user account and is collected in real-time when you have enabled journey tracking in the app. When you have journey tracking enabled your precise location is collected even when the app is in the background or closed. To enable this core functionality you must set the location permissions to “Always Allow” (iOS) or “Allow all the time” (Android).

By using the app, you agree to allow us to collect and use your location data as described above. If you do not want us to collect or use your location data, you can disable location services for the app in your device settings. However, please note that disabling location services will prevent the app from functioning as intended.

Log Data

Please be aware that when you use our Service, in case of an error in the app, we collect data and information (through third-party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites you visit and are stored on your device’s internal memory.

Our Pebbls platform and website utilize cookies to enhance user interactions and gather insights that help us refine your experience. If you prefer not to utilize cookies, you are free to exit the Pebbls website.

Service Providers

We may employ third-party companies and individuals due to the following reasons:

• To facilitate our Service;
• To provide the Service on our behalf;
• To perform Service-related services; or
• To assist us in analyzing how our Service is used.

Please be informed that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

Sharing Data with Strava

If you choose to upload your journey legs to your Strava account, we will share certain information with Strava to facilitate this upload. The information we share may include your location data, the duration and distance of your journey legs, and your leg title and description. Please note that when you add your leg to Strava your entire leg GPS track will be uploaded – any start and end location masking will be ignored.

Strava has its own privacy practices and you should review those in Strava’s Privacy Policy. We do not control what data Strava collects, how they use that data, or what they do with it.

Your data is only shared with Strava when you tap the “Add to Strava” button in the Pebbls tracking app. If you do not want us to share your data with Strava, do not link your Pebbls and Strava accounts. If you have already linked your accounts and want to stop sharing data, you can unlink your accounts in your Strava account settings.

Security

We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Children’s Privacy

These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to take the necessary actions.

We recognize that our app can be a valuable educational tool for users of all ages. While our services are designed for adults, we understand that children may also find value in using our app. As such, we permit children under the age of 18 to use our app, but they must do so under the supervision and guidance of a responsible adult. This adult may be a parent, guardian, or other responsible party who has reached the age of majority in their jurisdiction.

Any information provided by or about a child under the age of 18 must be submitted by and under the oversight of the responsible adult. The adult is also responsible for ensuring the child’s compliance with our terms of use. If you are a parent or guardian and you are aware that a child under your supervision has provided us with personal information without your consent, please contact us so that we will be able to take the necessary actions.
